Nicole Aeschleman is an attorney located in San Jose specializing in the practice of family law in Santa Clara, Alameda and San Mateo Counties. Ms. Aeschleman has worked for five years under the mentorship of a certified family law specialist and has her own law practice where she offers customized arrangements to meet the needs of individual family law clients.
Ms. Aeschleman chose to practice family law because of her desire to work closely with clients, while assisting them to solve a variety of challenging issues that arrive in the family law context. Ms. Aeschleman has significant experience with dissolution of marriage, annulment and paternity actions. She has handled issues ranging from child custody and visitation, child and spousal support, valuation of property, division of assets and debts, complex separate property claims, domestic violence, date of separation issues and breach of fiduciary duty claims, among others.
Ms. Aeschleman has experience with both simple and complex custody and visitation matters. She has handled from beginning to completion custody cases involving domestic violence, substance abuse, move-away requests and issues of parental alienation.
Ms. Aeschleman is especially skilled and talented with handling complex financial matters that arise in the family law context, including support matters and property division. She graduated from Santa Clara University with an undergraduate degree in Finance, she worked in the finance field before law school, and in law school, she focused on business law classes. She has experience with financial issues such as the tracing of assets, assessment of reimbursement claims, valuation of stock options, retirement plans and real and personal property, as well as assessment and litigation of permanent spousal support. Ms. Aeschleman also has experience managing complex property cases that require the forensic accountant investigation.
Ms. Aeschleman also prepares pre-nuptial and post-marital agreements for clients seeking both simple and complex agreements. She assesses the individual client’s needs and prepares a custom agreement based on what is appropriate for that client’s situation.
Ms. Aeschleman attended Santa Clara University School of Law, where she served as the Senior Articles Editor for the Santa Clara Law Review, was a research assistant for a professor, completed a judicial externship and served as a law clerk.

Tristan Aeschleman is an attorney working at the Law Office of Nicole L. Aeschleman. Mr. Aeschleman is passionate about family law because it provides him with an opportunity to help clients through what is often one of the most challenging situations in their lives.
Over the last three years, Mr. Aeschleman has gained valuable experience in family law. During law school, he worked at the Veteran’s Legal Assistance Clinic, where he helped veterans with an array of family law matters, varying from dissolution of marriage to enforcement of child custody orders. Since graduating law school, he has worked on cases involving custody, child support, spousal support, breach of fiduciary duty, and domestic violence.
Mr. Aeschleman graduated from the University of San Diego in 2007 with an undergraduate degree in Political Science. After attending the University of San Diego, he went on to attend Thomas Jefferson School of Law, where he obtained his Juris Doctorate. Mr. Aeschleman passed the California Bar Examination in July of 2011, and looks forward to a challenging career in family law.

Malinda Mascareñas joined The Law of Nicole Aeschleman in 2009 where she serves as Ms. Aeschleman's assistant and paralegal. Ms. Mascareñas works closely with Ms. Aeschleman to ensure that clients receive prompt and courteous attention. Ms. Mascareñas also assists Ms. Aeschleman with paralegal functions, which reduces fees and costs for the clients.
Prior to joining The Law Office of Nicole Aeschleman, Ms. Mascareñas had 12 years of experience working as an administrative assistant. Ms. Mascareñas obtained an Associate's Degree in Paralegal Studies and Liberal Studies from West Valley College in 2006. Ms. Mascareñas enjoys working with family law clients as she finds it rewarding to know that she is helping someone through a difficult time. |
